Design Preowned ApS (“DPO”, “we”, “us”, “our”) is fully committed to protecting your personal data. This Privacy Policy explains how we collect, process, store, and protect your information when you visit our website or engage with our services, in accordance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679).

General Terms & Conditions

Scope & Applicability

These general terms and conditions apply to all offers, orders, rental agreements, deliveries, and payments where Design Preowned ApS is the supplier, unless otherwise agreed in writing.

Offers

All offers are non-binding and subject to errors, omissions, or changes. Offers are valid for 30 calendar days unless stated otherwise.

Rental & Loan Terms

DPO retains ownership of all rented or loaned items. The customer is liable for any damage beyond ordinary wear and tear. Repairs are billed to the customer.

Agreement Formation

A contract is considered binding upon issuance of a written order confirmation by DPO. The confirmation, together with these terms, governs the legal relationship.

Pricing

Prices are stated in order confirmations or final agreements and are exclusive of VAT and other taxes unless explicitly agreed.

DPO reserves the right to adjust prices with one month’s notice.

Returns, Cancellations & Order Changes

Returns are not accepted after delivery.
Order cancellations or modifications require written approval and are subject to a 50% cancellation fee of the net order value.

Delivery & Installation

Unless otherwise agreed, delivery is EXW (Ex Works) from DPO’s warehouse in Nordhavn, Denmark, in accordance with Incoterms 2020.
Installation is not included unless separately agreed in writing.

Warranty

DPO warrants that its products will function as intended for 2 years from the date of dispatch, under normal use and in accordance with the product’s specifications.

Product Changes

DPO reserves the right to modify design, materials, and dimensions without prior notice.

Payment Terms

Unless otherwise agreed, payment is due upfront within 8 days before the delivery invoice date. Late payments incur 1.5% interest per month started.

Retention of Title

Goods remain the property of DPO until full payment has been received.

Claims

All claims must be submitted in writing within 8 days of delivery. After that, goods are deemed accepted.

Limitation of Liability

DPO shall not be liable for indirect or consequential damages, delays, or defects beyond the scope of the stated warranty.

Force Majeure

DPO is not liable for delays or failure to perform due to circumstances beyond its control, such as strikes, war, pandemics, or natural disasters.

Assignment

The customer may not assign rights or obligations under this agreement without DPO’s written consent.

Governing Law & Jurisdiction

This agreement is governed by Danish law. Any disputes shall be settled at the Court of Copenhagen.
